Terms of Service

Welcome to Mistlepaws. These Terms of Service govern your access to and use of mistlepaws.shop and any purchase you make from us. By placing an order you agree to these terms. Please read them before you buy.

In these terms, "we", "us" and "our" mean Mistlepaws. "You" means the person placing the order.

1. Who we are and how to reach us

Email is our support channel. We answer every email within 24 hours, seven days a week.

2. Eligibility

  • You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.
  • You must provide a delivery address that is accurate and complete. We are not responsible for a parcel delivered to an address you entered incorrectly.

3. Orders and acceptance

  • An order placed on mistlepaws.shop is an offer to buy. Your order is accepted when we send you an order confirmation email.
  • We may decline or cancel an order at any time before dispatch, including where the item is unavailable, where the price or description was published in error, or where we suspect fraudulent activity. If we cancel, you are refunded in full.
  • Order confirmations are sent to the email address you entered at checkout. Check your spam folder before contacting us about a missing confirmation.

4. Pricing and payment

  • All prices are shown in United States Dollars (USD) and include any applicable tax.
  • Payment is taken in full at checkout. We accept the payment methods displayed on the checkout page.
  • Your bank or card issuer may apply a currency conversion or international transaction fee. That fee is set by them, not by us.
  • Any compare-at price shown alongside a product is our own reference price for that item. Promotional pricing applies only while the promotion is displayed.

5. Shipping and delivery

  • We ship worldwide, with free shipping and no minimum spend.
  • Dispatch and transit times are set out in full in our Shipping Policy, which forms part of these terms.
  • Risk in the goods passes to you on delivery.
  • Import duties or taxes charged by your own country are your responsibility. We cannot calculate or pre-pay them.

6. Add-on services

Optional add-ons may be offered at checkout. Each is defined below. If you did not select an add-on at checkout, it does not apply to your order.

  • Shipping Protection. Covers your order against loss, theft or damage in transit. If your parcel is confirmed lost by the carrier, or arrives damaged, we replace it once at no cost to you, or refund it in full at your choice. Claims must be made within 30 days of the delivery date, or of the last carrier scan where the parcel never arrived.
  • Mystery Box. A physical bonus item, selected by us, shipped inside your order at no extra shipping cost. The contents are not disclosed before delivery and cannot be chosen, exchanged or returned separately. It is not a competition, a lottery or a game of chance, and it has no cash value.

7. Product safety, care and warranty

  • The Mistlepaws‚Ñ¢ Standing Dog Costume is a soft costume for dogs. It is a hood, a collar and a front panel with two stuffed decorative arms and two stuffed decorative legs attached to the front. The back is open by design.
  • It is dress-up only. It is not a harness, a coat, a lead attachment or a restraint. Never clip a lead, tie-out or any other line to any part of it.
  • Your dog must be supervised the entire time the costume is on. Take it off before your dog is left alone, crated, put in a car, fed, or allowed to sleep.
  • Check the fit before every wear. It should sit loosely over the shoulders and chest. If it presses on the throat, restricts the front legs, or your dog cannot move normally, take it off and do not use it.
  • Take it off immediately if your dog chews or pulls at the stuffed arms or legs, or at the hat, buttons or trim. Stuffing and small decorative parts are a choking and blockage hazard if swallowed.
  • Keep the costume and its packaging away from children and from animals that are not wearing it.
  • Not intended for use in heavy rain or snow, or in heat. A dog can overheat in an extra layer. Watch for panting and remove it if your dog looks uncomfortable.
  • Care: hand wash cold with a mild detergent, reshape the stuffed parts while damp and air dry flat. Do not machine wash, tumble dry, bleach, iron or dry clean. The stuffed parts will lose their shape if they are wrung out or put through a machine.
  • Do not alter the costume. Cutting, restitching or adding attachments voids all warranty cover.
  • Standard warranty: we warrant the costume against manufacturing defects for 12 months from the delivery date. This covers defects in materials or workmanship, such as a seam that fails or a part that arrives detached. It does not cover chewing, tearing, normal wear, accidental damage, or damage caused by an animal or person using it outside its intended purpose. Our remedy is a replacement or a refund at our option.

8. Returns and refunds

Our Refund Policy sets out your return rights in full and forms part of these terms. Where our Refund Policy and these terms differ, the Refund Policy applies to returns.

9. Intellectual property

  • All content on mistlepaws.shop, including the Mistlepaws name, logo, product designs, photographs, video and written copy, is owned by us or licensed to us.
  • You may not copy, reproduce, resell or commercially use any of it without our written permission.

10. Reviews and content you send us

  • If you send us a photo, video, review or comment, you grant us a non-exclusive, royalty-free licence to use it in our marketing and on our website and social accounts.
  • You confirm the content is yours to give and does not infringe anyone else's rights.
  • We may remove any content that is unlawful, misleading, abusive or off-topic.

11. Limitation of liability

  • Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
  • To the extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order.
  • To the extent permitted by law, we are not liable for indirect or consequential loss.

12. Events outside our control

We are not liable for a delay or failure to perform caused by an event outside our reasonable control, including manufacturing delays, carrier disruption, natural events, industrial action or government action. Where such an event occurs we will contact you and, if you prefer, cancel and refund your order.

13. Governing law

These terms are governed by the laws of Australia. Nothing in them limits your rights under the consumer law of your own country where that law applies to your purchase.

14. Changes to these terms

We may update these terms. The version published on mistlepaws.shop at the time you place your order is the version that applies to that order.
